6 Bassen Named Plaintiffs Decisions Received from Army BCMR

Major Decisions in the Fight for Military Back Pay

At Military Back Pay PLLC, our mission is clear: to restore the honor, pay, and benefits that thousands of service members rightfully earned prior to failing to comply with the now rescinded Department of Defense Covid-19 Vaccine Mandate.

One of the three litigations we are pursuing—the Bassen et al v. United States case—is already delivering groundbreaking results. This case was filed on behalf of active-duty service members who were involuntarily discharged while on Title 10 active-duty orders because of their vaccination status. It also extends protections to those pressured into early retirement or constructively discharged for the same reason.

At its heart, the Bassen case is about holding the government responsible for unfair separations—and ensuring that the pay and benefits are restored for all veterans and service members who rightfully earned them with their honorable service.

Recent Breakthroughs: September 15th Board Rulings

On July 16th 2025, our team filed submissions at the court’s order to the military correction boards on behalf of the ten named plaintiffs in Bassen et al v. United States:

  • 6 to the Army Review Boards Agency
  • 3 to the Air Force Board for Correction of Military Records
  • 1 to the Board for Correction of Naval Records

On September 15th 2025, we received official responses for the six plaintiffs before the Army Review Boards Agency—and the rulings were a resounding victory.

All six US Army service members were granted real and meaningful relief, which included some or all of the following:

  • Amendments to discharge status and orders
  • Restoration of back pay, bonuses, and allowances
  • Reinstatement of lost benefits
  • Removal of derogatory COVID-19 documentation
  • Elimination of GOMORs (General Officer Memoranda of Reprimand)
  • Cancellation of wrongful indebtedness
  • Upgrade of discharge codes
  • Removal of any reference to COVID-19 misconduct

These board decisions and results are critical because they signal and set the precedent of the government confirming fault and their plan for relief. It is a major step forward in reclaiming the pay, rank, and dignity that these service members earned.

Why This Is SO IMPORTANT for Current and Future Claimants

These victories are proof of the effectiveness of our legal team’s strategy. Cases like this, especially those that include the United States Government, can be incredibly complex. It could be confusing, costly, time consuming, and likely incredibly frustrating to try to pursue this on your own. Without legal representation, many service members risk:

  • Denial of relief due to technical filing errors or incomplete documentation.
  • Losing out on full available compensation, including bonuses, allowances, and benefits that they may not know to claim on their own.
  • Prolonged delays in the process because they lack the leverage of an organized, coordinated legal action.

Our Military Back Pay team has the experience, resources, and determination to hold the government accountable and maximize outcomes for those who have served and help to get the compensation they deserve. The decisions received on September 15th show what is possible when service members stand together through strong legal action rather than trying to fight alone.
